Chesterfield Borough Council has been successful in prosecuting a firm after it was found not to have put security fencing in place to protect trees.

A Tree Preservation Order was established at the former Woodlands Nursing Home site at Atlee Road, Inkersall Green, where a doctor's surgery and pharmacy are due to be built.

Six individual trees are protected by the order, which requires protective fencing to be placed around the foot of the trees during construction stages.

Jaybuild Projects Ltd was found not to have erected the security fencing, which meant that four of the trees were damaged by a mechanical digger.

Two Cherry trees, a Norway Maple and a Beech all consequently have serious damage to their roots, therefore affecting their health and the potential of future survival.

Jaybuild Projects Ltd was therefore fined £1,000, as well as being ordered to pay £180 costs and a £15 victim surcharge.
